What’s the difference between BAA and BABA?

That’s a great question.

The lighting industry has been familiar with Buy American and Build America, Buy America requirements for a while now.  Either and/or both have often been required for transportation, infrastructure, or military projects that receive federal funding.

Let’s get into it.

 

Buy American Act (BAA)

Products that are NOT predominately iron and/or steel – such as most lighting products – must meet the following requirements:

  • Final manufacturing & assembly point must be in the U.S.
  • Domestic content must be greater than the percentage listed below, by cost.

BAA Original: Domestic content must be greater than 55%
BAA 2024: Domestic content must be greater than 65%
BAA 2029: Domestic content must be greater than 75%

Products that ARE predominately iron and/or steel must be 100% manufactured in the U.S.

This longstanding act specifically applies when the Federal government is purchasing products for their own projects.

Build Amerca, Buy America Act (BABA/BABAA)

BABA, established as part of the Infrastructure Investment and Jobs Act (IIJA) on November 15, 2021, strengthens the current law, and focuses on the federal government’s use of domestic services, goods, products, and materials produced and offered in the US.

Products that are manufactured product – such as lighting products – must meet the following requirements:

  • Final manufacturing & assembly point must be in the U.S.
  • Domestic content must be greater than 55% percent by cost.

Products that are a raw material and are predominately iron and/or steel must be 100% Manufactured in the U.S.

This specifically applies when the Federal government is providing financial assistance for a covered infrastructure project.
